
WHO CAN APPLY A sole proprietor, a registered partnership firm, a duly incorporated Pvt. Ltd. Co./Ltd Co shall be eligible to. A proposed partnership firm/company can also apply provided names of the all-proposed partners/ shareholders/directors are clearly mentioned.
PERMITTED PROJECTS While submitting project summary along with the application, the applicants should refer to permitted project list. However, applicants may also apply for a different project which been approved by Kerala State Pollution Control Board.
HOW TO APPLY An application form accompanied with synopsis about the proposed project, Nature of the business, location feasibility report, required licenses, waste management plan, skilled and unskilled labour requirements, parking slot/size requirements, vehicular movement plan, expected working hours.
PLOT ALLOTMENT Applications enclosed with all requisite documents will be screened by a team designated/ constituted for this purpose and clarification will be collected through questionnaires. Projects which are prima facie cleared will be called for one-to-one interactions.
EXECUTION OF LEASE DEED The lessee will have to execute the lease deed within 90 calendar days from the date of issue of allotment letter. In case of failure to execute the lease deed within the above-stipulated period, the allotment may be cancelled and any amount paid would be forfeited as per rules.
MODE OF PAYMENT AND PAYMENT PLAN After issue of formal Allotment Letter, the lessee shall be required to pay 10% of the total earnest amount of the plot as allotment money within 10 calendar days from the date of issue of such allotment letter after adjustment of reservation money if any.
LEASE RENT In addition to the earnest amount of plot, monthly lease rent is payable either from date of execution of legal documentation or from the date specified in the execution document. In case of default in payment of lease rent the interest @ 12% half yearly compounded (GST shall be applicable extra) on the defaulted amount for the defaulted period.
EARLY TERMINATION OF LEASE The lessee can surrender the Industrial Plot/Premises in favour of REGENT PARK. The REGENT PARK may permit the surrender of the plot, subject to necessary deductions, as per the prevailing policy of the REGENT PARK at the time of surrender, from the deposits made by the lessee to REGENT PARK.
STAMP DUTY AND REGISTRATION/ TERMINATION CHARGES The stamp duty, registration charges and all other legal expenses involved in the execution and registration/termination of lease deed and all other incidental expenses towards lease execution / termination shall be borne by the lessee. The rate of stamp duty applicable shall be as per the notification issued by the Government/local bodies of Government from time to time.
AREA OF THE ALLOTTED PLOT The actual area of the plot allotted or handed over may slightly vary from the size of the plot allotted/applied for. If area of the plot mentioned in allotment letter and actual area handed over to the applicant is found to be different, a proportionate change in the amount of the earnest money would be made. No communication in this regard shall be entertained by the REGENT PARK on the ground of variation in the size of plot.
CONSTRUCTIONS OVER THE ALLOTED PLOT All the constructions done by lessee at allotted plot will be treated as temporary and removable at the expense of lessee, irrespective of its mode/material or complexity in construction. Lessee should get written permission and approval of plan from REGENT PARK well before each and every construction and amendments.
FUNCTIONAL/COMPLETION It will be essential for the lessee to complete the construction and make the unit functional/completion within 180 Calendar days from the execution of lease deed. If the unit has not become functional within the time, then the lessee must submit a written request for extension of the period.
TRANSFER OF PLOT The allotted plot shall not be transferred without declared functional by REGENT PARK. No request for transfer or Change In Constitution (CIC) shall be entertained for 6 months from the date of allotment except in cases of blood relations. All CIC requests are chargeable.
LIABILITY OF MAINTENANCE The lessee at his own expense will take permission for sewerage, electricity and water connections from the concerned departments of the Authority or from the competent authority in this regard.
PAYMENT OF TAXES CEO of REGENT PARK will be the sole owner of the entire land property of this commercial space. REGENT PARK will be liable to pay land tax imposed by Government or local bodies of government from time to time. The lessee/lessee would be liable to pay all taxes/charges and assessment of every description in respect of plot whether assessed, charged or imposed on the plot because of the construction or on the temporary structures constructed thereon, from time to time.
EXHIBITION OF ADVERTISEMENTS The lessee/lessee shall not display or exhibit any picture, posters, statues, and other articles, any advertisement which are repugnant to the morals and/or are indecent or immoral. The lessee should get prior permission to display or exhibit any advertisement in any part of the exterior wall of the building/shed/plot.
CONSEQUENCES OF MISREPRESENTATION If the allotment is found to be obtained by any misrepresentation, concealment, suppression of any material facts by the lessee/lessee, the allotment of plot will be cancelled and/or lease will be determined, as the case may be. In addition, the entire money deposited by the lessee/lessee shall be forfeited and legal action for such misrepresentation, concealment and suppression of material facts shall be taken.
CONSEQUENCES OF BREACH OF TERMS & CONDITIONS The REGENT PARK can exercise its right to cancellation of allotment of plot on account of breach of terms and conditions of allotment/lease deed/transfer deed. However, the REGENT PARK can restore the allotment of the plot. In case of restoration, lessee/lessee would pay restoration charges as per the prevailing policy of the REGENT PARK & have to follow other conditions of restoration of the allotment.
